TERMS & CONDITIONS
Barlow Bespoke Flowers creates 'made to order' floral arrangements. Please see below for further details of the ordering process and terms of ordering and sale. Please read all of these terms and conditions before placing your order. As we can accept your order and make an enforceable agreement please make sure that they contain everything you want and do not include anything that you may be unhappy to accept.
1. These terms and conditions will apply to the purchase of goods by you ('the customer' or 'you'). We are Kate Barlow trading as Barlow Bespoke Flowers ('we', 'us', 'Kate', 'our' or 'Barlow Bespoke Flowers').
2. These are the terms by which we sell our goods to you. By ordering any of our goods you agree to comply with these term and conditions.
3. The description of the goods to be supplied is agreed on during the ordering process as every order is 'made to order' or a 'personalised design'.
4. Due to the nature of floristry and each flower potentially being unique there may be slight differences in photographs of example stock and that which is supplied to you.
5. In the case of any goods made to your special requirements, it is your responsibility to ensure any information that you provide in your specification is accurate.
6. All goods offered are subject to availability.
7. We can make changes to our goods that we deem necessary for safety or supply reasons. We will notify you of any changes which may affect your order.
8. The description of goods offered in our advertisement does not constitute a contractual offer to sell the goods. When an order has been submitted we retain the right to reject the order for any reason, we will try to tell you the reason without delay.
9. The order process is set out below, it is your responsibility to ensure that you have read the order process correctly. Order Process and Payment Schedule:
• £10 non refundable deposit to be paid at the time that the order is accepted to secure the date of your order.
• 4 months before the date of the order 50% of the balance agreed is to be paid.
• Once this payment is recieved by us you will receive an 'e-flower board' as part of the design. (This is a selection of pictures of the types of flowers that may be included in your arrangements, to help with the design process)
• Once the design is agreed the stock for your order will be purchased and at this point the 50% will become non refundable.
• We will always try to keep you up to date throughout the production of your order and if reasonable will send photographs of various parts of the process.
• Once production of your order is completed, full payment of the remaining balance including cost of postage/delivery is due to be paid.
• Your order will not be dispatched until full payment is recieved. (This schedule is our normal process and timeline, some orders completed as emergencies or a shortened timescale will be subject to variations in these terms)
• Orders on a shortened timescale or emergency basis will usually be charged at 50% non refundable payment at the time of order and then full payment before dispatch as per terms above.
10. The price of goods, any additional postage or delivery or other charges will be confirmed at the time that the order is confirmed by us.
11. You must pay promptly as agreed above or at the time of ordering. Payment can be made via PayPal or Bank transfer. This will ensure that the schedule agreed upon can be upheld.
12. You do not own the goods until we have recieved payment in full. If payment is not made in full and on time we reserve the right to cancel or delay your order.
13. Delivery of goods will be subject to reasonable time/day variations due to the nature of postage and courier services. It is your responsibility to ensure that you are able to receive your goods at the time of delivery.
14. Once you have recieved the goods you are responsible for keeping them in good condition and preventing damage to them. We accept no responsibility for any damage to the goods once you have recieved them.
15. You may cancel your order at any time however we retain the right to refuse refund of any payments made once the materials for your goods have been ordered.
16. If you choose to cancel your order we retain the right to reuse any materials purchased for your order, without notifying you or to resell any arrangements made for you that you have chosen to cancel.
17. If you change your mind about the design you would like, any additional cost will be covered by you, and times for completion of your order may be subject to change.
18. In event of any failure by either party that is out of their reasonable control; each party agrees to contact and inform the other party as soon as reasonably practical.
19. Barlow Bespoke will only cancel your order if it is beyond our reasonable control, or you have failed to comply with the terms of our agreement or if you have failed to make payment as per the agreement.
